Terms of Service

1. Acceptance of Terms

By accessing and using VizStack ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

VizStack reserves the right to update and change the Terms of Service without notice. Any new features that augment or enhance the current Service shall be subject to the Terms of Service.

2. Account Terms

• You must provide a valid email address and any other information requested in order to complete the signup process.
• You are responsible for maintaining the security of your account and API keys. VizStack cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You are responsible for all content generated and activity that occurs under your account.
• You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.
• One person or legal entity may not maintain more than one free account.

3. API Usage and Restrictions

Your use of the VizStack API is subject to the following restrictions:

• You must not exceed the rate limits specified in your plan tier.
• You must not use the Service to generate charts for illegal, harmful, or misleading purposes.
• You must not attempt to reverse engineer, decompile, or discover the source code of the Service.
• You must not resell, duplicate, reproduce or exploit any part of the Service without express written permission.
• API keys are confidential and must not be shared publicly or embedded in client-side code.

4. Payment and Billing

For paid plans, the following terms apply:

• A valid credit card is required for paying accounts. Free accounts are not required to provide credit card details.
• The Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months of service.
• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes.
• For any upgrade or downgrade in plan level, your credit card will automatically be charged the new rate on your next billing cycle.
• Downgrading your Service may cause the loss of features or capacity of your account. VizStack does not accept any liability for such loss.

5. Service Level and Uptime

VizStack strives to maintain 99.9% uptime for paid plans. However, we do not guarantee uninterrupted access to the Service and will not be liable for any disruption of service due to:

• Scheduled maintenance (with advance notice when possible)
• Circumstances beyond our reasonable control, including force majeure events
• Your breach of these Terms of Service
• Third-party service provider failures

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in our Privacy Policy, including:

• Account information and authentication data
• API usage data and request logs
• Chart data you submit for rendering (temporarily stored for processing)
• Billing and payment information

We do not permanently store or analyze your chart data unless you explicitly save it to your account. Data submitted to our API is processed and deleted after rendering is complete.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of VizStack and its licensors. The Service is protected by copyright, trademark, and other laws.

Charts generated using the Service are your property. You retain all rights to the data you submit and the charts you generate. VizStack claims no ownership over your content.

8. Termination

VizStack, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time. Such termination will result in the deactivation or deletion of your account.

You may cancel your account at any time by contacting us at support@vizstack.dev. Upon cancellation, your access to the Service will be terminated immediately.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall VizStack, its affiliates, agents, directors, employees, suppliers or licensors be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. VIZSTACK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts located in the United States.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
